At Rosen Sunshine, we help physicians with a range of professional regulation proceedings with the College of Physicians and Surgeons of Ontario (CPSO), including complaints, investigations and discipline matters, appeals, registration proceedings, peer reviews, and fitness to practise matters.

We also represent physicians in hospital complaints, privilege challenges, and other workplace or practice related disputes. This includes advocacy at the first sign of a complaint or concern, assisting physicians in meetings with administration or at meetings of the Credentials Committee or Medical Advisory Committee, and representing physicians in hearings before the hospital board of directors or the Health Professions Appeal and Review Board.

When disputes arise among physicians in group practices or arrangements, such as Family Health Organizations (FHOs) or Family Health Teams (FHTs), we represent individual physicians or the group, and advise on related professional and patient care issues. Physicians who embark upon new business ventures or creative models for the delivery of care are well advised to seek legal advice before moving forward, and we have a great deal of experience in providing such advice. Providers of independent examinations (IEs) are uniquely at risk of complaints from IE subjects or their representatives, and we are experienced in representing providers and in advising on best practices for IEs. We also provide advice on legal compliance issues and representation in appeals and before various tribunals, boards, and courts.

Physicians who bill OHIP are subject to reviews and audits of their billings. We assist physicians with all types of audits, reviews and inspections and represent them in billing matters, whether responding to inquiries from OHIP or in proceedings before the Physician Payment Review Board or the Health Services Appeal and Review Board.

Physicians who advertise or post on social media must comply with the CPSO’s Advertising Policy, about which we have spoken and written. We regularly review physicians’ advertising and make recommendations to ensure compliance with the Advertising Policy and the advertising regulations governing physicians.
